Welcome to NXFY! These Terms & Conditions govern your use of our website and services, including web design, web development, mobile app development, branding, digital marketing, and related creative solutions. By using our website or purchasing our services, you agree to comply with and be bound by the following terms.

Services Provided

NXFY offers professional digital services to help businesses build, promote, and maintain their online presence, including:

Web Design & Development: Custom websites, landing pages, e-commerce stores, web portals, and responsive design solutions.
Mobile App Development: iOS and Android application design and development tailored to your business goals.
Branding & Creative: Logo design, brand identity, animated videos, and explainer videos.
Web Maintenance & Support: Ongoing updates, hosting support, and website management services.

Payment Terms

By purchasing our services, you agree to pay the fee specified for the selected package or custom project. Payment is required as outlined in your order agreement unless otherwise stated. We accept approved payment methods including credit cards and other methods authorized by NXFY. All payments are non-refundable once work has commenced, except as stated in our Refund Policy below.

Ownership and Copyright

Upon full payment for completed services, you will receive ownership rights to the final deliverables as defined in your project agreement, including approved website designs, branding assets, and related materials created specifically for your project. NXFY retains the right to display completed work in its portfolio unless otherwise agreed in writing. Any third-party assets, stock images, fonts, or licensed materials must be purchased separately unless included in your package.

Client Responsibilities

You agree to provide accurate, complete, and timely information required for us to deliver your project. Delays caused by missing content, late feedback, or incomplete requirements may affect delivery timelines. NXFY is not responsible for errors in the final product caused by inaccurate or incomplete information provided by the client.

Revisions and Feedback

Each service package includes a defined number of revision rounds as outlined in your order or proposal. Additional revisions beyond the agreed scope may incur extra charges. Please provide clear and detailed feedback so we can deliver work that meets your expectations.

Confidentiality

NXFY values your privacy. We agree to keep project-related information confidential, including business details, creative briefs, and proprietary content shared during the engagement. We will not disclose your materials to third parties without your consent, except as required by law.

Delivery Times

We strive to deliver all services within the estimated timelines provided at the time of order. Delivery dates are estimates and may change based on project complexity, revision requests, or delays in client feedback. We will notify you of any significant changes and work with you to complete your project efficiently.

Limitation of Liability

While we aim to provide high-quality services, NXFY is not liable for any direct, indirect, incidental, or consequential damages arising from the use of our services, including delays, technical issues, or failure to meet specific business outcomes. We do not guarantee specific results such as search rankings, sales volume, or marketing performance.

Refund Policy

Due to the custom nature of our services, fees are generally non-refundable once work has begun. A refund may be considered only if agreed services have not been delivered as outlined in your order. Refunds are not available if:

Work has been in production for more than 30 days and deliverables have been shared.
The client has requested revisions or approved delivered work.
The client changes their mind after work has started.
Backend or admin access to a completed website has already been provided.

Refund requests must be submitted within 25 days of delivery. Service charges may be deducted from any approved refund amount. Once a project is closed by the client outside of NXFY's process, a cancellation fee of up to 50% of the project cost may apply.

Website Maintenance Responsibility

Once a client is given access to the backend of a completed website, NXFY is not responsible for changes, errors, or issues caused by the client or third parties unless a separate maintenance agreement is in place.

Termination of Services

NXFY reserves the right to suspend or terminate services if the client violates these Terms & Conditions, fails to make payment, or engages in abusive or unethical conduct. In such cases, the client remains responsible for payment for work completed up to the date of termination.

SMS Messaging Terms

By providing your mobile phone number and opting in through our website forms, you agree to receive SMS text messages from Nxfy LLC related to your inquiries, project updates, appointment reminders, and customer support. Message frequency may vary. Message and data rates may apply. Reply STOP to cancel at any time. Reply HELP for help. Consent to receive SMS messages is not a condition of purchasing any goods or services. Carriers are not liable for delayed or undelivered messages.

SMS Program Scope: This phone number and SMS program are used exclusively to communicate with Nxfy LLC customers about their own projects, appointments, account updates, billing notifications, and support requests. These messages are not used to send marketing campaigns on behalf of third parties or client businesses.
